These Terms of Service ("Terms") govern your use of the Blue-Caller AI receptionist services provided by Blue-Caller AI LLC ("Blue-Caller," "we," "us," or "our"). By using our services, you agree to these Terms.
1. Services
Blue-Caller provides AI-powered phone reception services for businesses. Our service answers incoming calls, collects caller information, and sends notifications to business owners via SMS and/or email. We do not schedule appointments, provide quotes, or make commitments on behalf of your business.
2. Eligibility
You must be at least 18 years old and have the authority to bind your business to these Terms. By using our services, you represent that you meet these requirements.
3. Account Responsibilities
You are responsible for:
- Providing accurate business information
- Maintaining the confidentiality of your account
- All activities that occur under your account
- Following up with leads in a timely manner
- Complying with all applicable laws and regulations
4. SMS Text Messaging Terms
By providing your phone number and opting in to Blue-Caller notifications, you agree to the following:
- Consent: You expressly consent to receive SMS text messages from Blue-Caller at the phone number you provide. These messages include missed call alerts, caller information, service request details, emergency notifications, and account-related communications.
- Message Frequency: Message frequency varies based on your business call volume. You may receive between 1 and 20 messages per day, depending on incoming call activity.
- Message and Data Rates: Standard message and data rates from your mobile carrier may apply to messages you receive.
- Opt-Out: You may opt out of SMS notifications at any time by replying STOP to any message. You will receive a confirmation message and no further texts will be sent unless you re-subscribe.
- Help: For assistance, reply HELP to any message or contact us at support@blue-caller.ai or (908) 217-3908.
- Supported Carriers: Service is available on most major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
- No Mobile Information Sharing: We do not sell, rent, or share your mobile phone number or SMS opt-in data with third parties for their marketing purposes.
5. Acceptable Use
You agree not to use our services to:
- Violate any laws or regulations
- Engage in fraudulent or deceptive practices
- Harass, abuse, or harm others
- Interfere with or disrupt our services
- Collect information about callers for purposes unrelated to your business
6. Service Limitations
Our AI receptionist:
- Does not provide emergency services — callers with emergencies are instructed to call 911
- Does not provide quotes, estimates, or pricing information
- Does not schedule appointments or make commitments
- Does not provide technical advice or troubleshooting
- May not be available 100% of the time due to technical issues
7. Fees and Payment
Pricing for our services will be communicated separately. For pilot program participants, services may be provided at no cost for a limited evaluation period. We reserve the right to modify pricing with notice.
8. Termination
Either party may terminate the service at any time. Upon termination:
- Your access to the service will be discontinued
- SMS and email notifications will stop being sent
- Data will be retained for a reasonable period then deleted
9. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL CALLS WILL BE HANDLED PERFECTLY.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE-CALLER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OUR SERVICES.
11. Indemnification
You agree to indemnify and hold harmless Blue-Caller from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
12. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles.
